These Terms of Service ("Terms") govern your use of the DögEar mobile application (the "App"), operated by DogearHQ ("DögEar", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 17 years old to use the App. By using the App you represent that you are 17 or older and are able to form a binding contract.
DögEar is a community feed of short videos organized by city. You can browse feeds, watch videos, and, with an account, vote on videos, save videos, and post videos to a feed. Videos in the App are references to content hosted on third-party platforms such as YouTube, TikTok, and Instagram, and play from or open on those platforms.
Some features require an account. You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
DögEar has no tolerance for objectionable content or abusive behavior. By using the App you agree not to post, share, or transmit content that is illegal, sexually explicit, sexually exploitative of or harmful to minors, violent or graphic, harassing, bullying, threatening, hateful, defamatory, or that infringes others' rights, and not to harass, threaten, impersonate, or abuse other people. A full description of prohibited content and conduct is in our Community Guidelines, which are incorporated into these Terms.
We reserve the right to remove any content and to suspend or permanently block any user or device that violates these Terms or our Community Guidelines. We act on reports of objectionable content by removing the content and ejecting the users who provided it. You can report content through the report control on each item, and you can contact us at [email protected].
You retain ownership of the content you create. Because DögEar references third-party videos rather than hosting them, when you post a video you represent that you have the right to share that reference and that doing so does not violate any law or any third party's rights, including the rights of the original platform and creator.
For any content or information you submit (including references you post, votes, reports, and profile information), you grant DögEar a worldwide, non-exclusive, royalty-free license to host, store, use, display, and distribute that content within the App for the purpose of operating and improving the service. This license ends when you delete the content or your account, except where the content has been shared with others who have not deleted it, or where we must retain it to comply with law.
DögEar uses YouTube API Services to help you discover popular public videos, which are played through YouTube's official embedded player. By using the App, you also agree to be bound by the YouTube Terms of Service. Your use of information retrieved through YouTube API Services is subject to the Google Privacy Policy. You can review and revoke DögEar's access to your Google or YouTube data at any time through the Google security settings page. Additional detail about how DögEar uses YouTube API Services is described in our Privacy Policy.
Videos are hosted by third parties and are subject to those platforms' terms and privacy policies. We do not control and are not responsible for third-party content, and the availability of any video may change or be removed by the platform at any time. Your use of any third-party platform is at your own risk and governed by that platform's terms.
You agree not to: use the App for any unlawful purpose; attempt to gain unauthorized access to the App or its systems; interfere with or disrupt the App; use automated means to access, scrape, or abuse the service; circumvent moderation, rate limits, or bans; or misuse the reporting tools.
The App displays advertising. Your interactions with ads, including any dealings with advertisers, are solely between you and the advertiser. See our Privacy Policy for how advertising data is handled.
We may, at our discretion and without notice, remove content, limit or suspend features, or suspend or permanently block accounts or devices that violate these Terms or our Community Guidelines, or where necessary to protect users or the service.
The App, including its design, software, and branding, is owned by DogearHQ and protected by law. These Terms do not grant you any right in our intellectual property except the limited right to use the App as intended.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that content is accurate, lawful, or non-infringing. We do not guarantee that the App will be uninterrupted or error-free.
To the maximum extent permitted by law, DögEar and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the total amount you paid us, if any, for the App in the twelve months before the claim. Because the App is free to download and use, this amount may be zero.
You may stop using the App and delete your account at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect the service or other users.
These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the App will be handled in the courts located in Pennsylvania, and you agree to those courts having jurisdiction.
We may update these Terms from time to time. If we make material changes we will update the "Last updated" date and, where appropriate, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
